Jay,

Thanks for explaining the situation but from your shot and comments I'm not sure you and I are in agreement.

First of all, from the angle of the shot it appears you are much closer than 40 yards to these birds. Since your friend's home is so close to the nest I can understand you shooting from his yard but I think you are getting much closer.

Also your comment that "My presence still tickes them off everytime I show up" tells me that you are having an affect on these eagles. You may feel this is great action for your images but I think this is probably not good for the eagles. I'm a strong believer that interfering with your subject is not worth a photograph and my friends will tell you I've walked away from many images if I see I've become a problem.

I hope that if you continue shooting these guys you are lucky and they continue raising bunches of chicks.
